A Polish PESEL number for foreign directors and entrepreneurs

PESEL is the personal identification number used in many Polish administrative and digital procedures. Not every foreign shareholder or director automatically needs one, but it can be highly practical for a person who actively manages a Polish company, files documents or wants access to Polish e-government services.

What is a PESEL number?

PESEL is a unique number in the Polish population register. It identifies individuals in dealings with public authorities and various public systems. The number is not a residence permit and does not by itself determine a person's tax residence.

How can a foreigner obtain PESEL?

A foreigner who registers a stay in Poland for more than 30 days will generally receive PESEL automatically. If residence registration is not possible but a Polish authority requires PESEL, an application can be submitted at a municipal office. The service is free; the applicant presents an identity document and signs the form personally.

Practical point: if an authority requires PESEL, ask it to identify the legal basis. That basis may need to be stated in the application.

Why is PESEL relevant for Dutch and Belgian entrepreneurs?

1. Profil Zaufany and Polish e-government

A foreigner can obtain a Polish trusted profile, but a PESEL number is required. Profil Zaufany enables access to many public systems and allows documents to be signed with a trusted signature.

2. KRS and financial documents

For companies registered in the Polish National Court Register, PESEL makes it easier to identify directors and authorised representatives. Certain free filings in the Financial Documents Repository require an authorised representative whose PESEL is disclosed in KRS.

3. Tax, ZUS and other registers

PESEL may serve as a tax identifier for an individual and simplifies dealings with the tax authorities and the Polish Social Insurance Institution. Whether PESEL or NIP is appropriate depends on the individual's status and activities.

4. KSeF and digital authorisations

PESEL can help with identification and granting permissions. It is not the only route: KSeF also supports authentication with a qualified certificate. If the certificate contains neither PESEL nor NIP, permissions can be linked to the certificate fingerprint.

Does every foreign director or shareholder need PESEL?

No. A passive foreign shareholder who does not sign Polish filings may have no immediate need for it. A director who regularly handles KRS, financial, tax or other administrative procedures will usually benefit much more from having one.

Practical checklist

  • Identify the exact procedure for which PESEL is needed.
  • Check whether residence registration in Poland is possible.
  • Prepare a valid identity document and the legal basis for the application.
  • After assignment, verify that personal details match the passport and KRS exactly.
  • Then consider Profil Zaufany and the company's digital authorisations.
